This Privacy Policy explains how Mayo Retina (“we,” “us,” or “our”) collects, uses, discloses, and protects information when you visit our website, mayo-retina.com (the “Site”).  We are committed to protecting your privacy in compliance with applicable U.S. federal and California state laws, including the California Consumer Privacy Act (as amended by the California Privacy Rights Act, collectively “CCPA”).  This Privacy Policy applies only to information collected through the Site.  It does not apply to protected health information (“PHI”) that we collect or maintain in our capacity as a healthcare provider, including any text or SMS appointment reminders.  PHI is governed exclusively by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and the California Confidentiality of Medical Information Act (“CMIA”).  For complete details about how we handle your PHI, including SMS reminders, please review our separate Notice of Privacy Practices, which is available upon request at our office or by contacting us using the information below.  

1. Information We Collect 

Because our website does not include contact forms, chat features, patient portals, appointment booking tools, newsletters, or any other interactive data-collection features, the amount of personal information we collect is very limited.  Automatically Collected Information (when you visit the Site): 

• Usage and device data: IP address, browser type, operating system, device identifiers, pages visited, time and date of visit, referring website, and general browsing activity. 
• Cookies and similar technologies: We may use essential cookies to enable basic website functionality. We do not use advertising or cross-site tracking cookies.

We do not collect: 

• Names, email addresses, phone numbers, or any other directly identifiable personal information through the Site. 
• Any health or medical information via the Site.

2. How We Use Your Information

We use the automatically collected information solely for the following purposes: 

• To operate, maintain, and improve the Site; 
• To analyze Site usage and trends (for internal purposes only); 
• To detect and prevent security threats or fraud; 
• To comply with legal obligations.

Note on SMS Appointment Reminders: Our office may send text message (SMS) appointment reminders as a convenience to patients.  These reminders are handled separately from the website (although our domain may be associated with the service provider we use).  These messages contain minimal information and are permitted under HIPAA as part of treatment. You may opt out of text reminders at any time by replying “STOP” to any message or by contacting our office.

3. Sharing and Disclosure of Information

We do not sell your personal information (as defined under the CCPA). We may share automatically collected information only in these limited circumstances: 

• With service providers who help us host or maintain the Site (e.g., web-hosting companies), under strict confidentiality agreements; 
• When required by law, court order, or governmental authority; 
• To protect the rights, property, or safety of Mayo Retina, our patients, or the public.

4. Cookies and Tracking Technologies

We use only strictly necessary cookies for basic site operation.  You may adjust your browser settings to block cookies; however, some parts of the Site may then not function properly.  We do not participate in any “Do Not Track” frameworks at this time because we do not engage in cross-site tracking.

5. Data Security

We implement reasonable administrative, technical, and physical safeguards to protect the limited information we collect.  However, no electronic transmission or storage method is 100% secure.

6. Your California Privacy Rights (CCPA)To the extent the CCPA applies to Mayo Retina (a small solo medical practice), California residents have the following rights regarding personal information collected through the Site: 

• Right to Know: Request confirmation of whether we have collected personal information about you and, if so, what categories and specific pieces. 
• Right to Delete: Request deletion of your personal information (subject to certain exceptions). 
• Right to Opt-Out of Sale: We do not sell personal information, so no opt-out is needed. 
• Right to Non-Discrimination: You will not receive discriminatory treatment for exercising your privacy rights.

How to Submit a Request:
Email us at the address below or call (657) 667-0817.  We will verify your identity before responding.  We will respond to verified requests within 45 days (or up to 90 days if we notify you of an extension).  Note: These CCPA rights do not apply to PHI governed by HIPAA or CMIA.

7. Children’s Privacy (COPPA)

Our Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13.  If you believe we have inadvertently collected such information, please contact us immediately so we can delete it.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.  We will post the revised version on the Site with a new effective date.  Your continued use of the Site after changes constitutes acceptance of the updated policy.
